Moldova faces first international justice case at UN for failing to support torture victims post-release

The Russian Federation and the Republic of Moldova have been reported to the UN regarding the case of Alexandr Dimov. The Promo-LEX Association and the European Prison Litigation Network have jointly filed a complaint, condemning the inhumane treatment and arbitrary detention he experienced on the left bank of the Nistru. They also emphasize the absence of effective rehabilitation mechanisms following his release.

Alexandr Dimov was abducted in May 2022 by the Ministry of Security in Tiraspol and illegally detained until February 2025. During this time, he endured torture, constant psychological pressure, isolation from his family, and a lack of adequate medical care.

A complaint has been filed at the international level, invoking the responsibility of the Russian Federation for serious violations of the International Covenant on Civil and Political Rights. This complaint specifically addresses arbitrary deprivation of liberty, the absence of a fair trial before illegal courts, inhumane conditions of detention, and arbitrary interference with private life.

A new element in this case is the accusation against the Republic of Moldova for failing to fulfill its obligations following the victim's release. The constitutional authorities did not provide necessary mechanisms for rehabilitation, medical and psychological care, or social support to help reintegrate an individual who has survived detention under a separatist regime.

Promo-LEX lawyer Nicoleta Hriplivîi highlighted that this complaint highlights a systemic issue that has been overlooked until now: the lack of operational support for citizens who manage to escape from illegal prisons on the left bank of the Nistru. The state has a duty to create the conditions for the reconstruction of these victims' lives.

“The Alexandr Dimov case not only reflects the severity of the abuses committed in the Transnistrian region but also illustrates the Republic of Moldova's failure to provide the necessary support for victims after their release to rebuild their lives. Moldova has a positive obligation to establish effective mechanisms for assistance, rehabilitation, and reintegration for victims of illegal detentions and torture. We are bringing this systemic problem, which affects victims of the occupation regime in Tiraspol, to the UN Human Rights Committee for the first time,” Hriplivîi stated.

It is important to note that an individual complaint to the UN Committee is an international mechanism that enables citizens to report violations of rights as stipulated in the International Covenant on Civil and Political Rights. The process includes two stages: verification of admissibility criteria and an actual analysis of the facts presented in the complaint.
